Hate crime is a manufactured term. Crime is crime no matter what the motivation or emotion felt at the time on the part of the perpetrator. Exactly what was the initial crime here that was aggravated by hate? She knocked a cell phone out of a nigger's hand? That's destruction of property at best and only if it was destroyed. Battery? If a crime and it's punishment can be legally aggravated by emotions then by extension it can be mitigated as well:

-Your honor, I had to kill her because I loved her.
-It made me sad because they had a better car than I did so I had to steal it.
